You represent that you are over the age of 16. The Company does not permit those under 16 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes our policies and procedures on the collection, use and disclosure of Your personal information, when You use the Website, Your privacy rights and how the law protects You. Definitions

For the purposes of these Terms and Conditions:

  • Affiliate –  an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.

  • Company – (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Greeting Yuh.

  • Country – refers to Jamaica

  • Device – any device that can access the Service such as a computer, a cellphone or a digital tablet.

  • Service – refers to the Website.

  • Terms and Conditions – (also referred as “Terms”) mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service. 

  • Third-party Social Media Service – any services or content (including data, information, products or services) provided by a third-party that may be displayed, included or made available by the Service.

  • Website – refers to Greeting Yuh, accessible from https://greetingyuh.com/

  • You – the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

We use our reasonable endeavors to make sure that every product on our Website is shown accurately and that prices are correct.  However, occasionally there may be small variations in colour, typefaces and layout.

Placing your order

A contract for the purchase of a product is created as follows:

  • The User places the order on the Site pressing an order confirmation button (“Checkout”) at the end of the checkout process: if the product in question includes content selected by the User it is a “personalised product”; if it is a standard product which does not include any content selected by the User it is a “non-personalised product”
  • By confirming your order, you are agreeing to purchase the product you have selected
  • At this point, we take payment for your order by means of your nominated payment method
  • We will send to you a “Thank you for your order” email detailing your order, and other information we will provide to you.

From time to time, we may reject an order for the following reasons:

  1. If, unfortunately, we do not have your chosen product in stock
  2. Where we cannot obtain authorization for your payment
  3. If there has been a relevant pricing or product description error
  4. If your order otherwise breaches any of the requirements of these Terms
  5. The use of images for a personalised product which are corrupted, unsupported technically or inadequately pixelated
  6. If a personalised product you wish to order contains anything which contravenes, or appears to contravene, our Content Rules (see section below for our Content Rules)
  7. We suspect that the order has been placed fraudulently
  8. It appears that the order mistakenly duplicates another order

If your order is rejected, we will contact you to confirm this and reverse the payment you have made for that order.

There are limited circumstances in which you may cancel an order after it has been made – see changing and canceling order tab.

Note that we may bar or prevent an individual Account, User, email address or other identifier from making purchases or otherwise interacting with us where we reasonably suspect an association with fraud or other infringements of the law.

You must be at least 16 years of age to use this website.

If you do not agree to these Terms, you must not use this website.

Personalizing products

We aim to provide you with a fast, high-quality service.  Please double-check your order on screen and carefully check that all the details are correct.  It is up to you to ensure that content you have contributed for inclusion in a personalised product is correct, and is correctly spelt.  We may allow you to make changes to your order whilst the status in your ‘Orders’ (under the ‘My Account’ tab) shows as ‘Order Received’.  if it is not possible to make the change on-screen (which depends upon the product ordered), then you will need to contact our Customer Service Team by:

By uploading, posting, contributing or including any content or material in a personalised product, you grant us a non-exclusive, royalty-free, irrevocable licence (including the right to grant sub-licences through multiple tiers) to use, reproduce, adapt, distribute and communicate to the public that content or material solely for the purpose of performing obligations and exercising rights under these Terms.  Note that we may modify content or material in order to conform to Our requirements of the product you have ordered (such as by cropping images).

If you are uploading a photo, images must be in JPEG or PNG format.  Any other format such as Word documents and PDFs cannot be accepted.  For best results, we advise that you make the image dimensions approximately 1,000 pixels for the smallest edge of your photos.  We print images at 300DPI (Dots Per Inch), so if you are scanning the image we recommend you use this setting.

If you try to upload a photo that has a lower resolution or image size, we will accept it.  However, an on screen warning will generally appear to let you know that the image may not appear very well on the selected personalised product.

Content Rules

We do not permit personalised products to include any content or material which:

  • Infringes anyone’s copyright: in particular, you must ensure that you either own the copyright in an image or any other content that you wish to include in a personalised product or that you are fully licensed by the copyright owner to include that image or other content in the personalised product.
  • Infringes any other rights, such as a trade mark, of any person or entity or a duty owed to any person or entity, such as a duty of confidentiality.
  • Contravenes any applicable law (including, without limitation, any criminal law) or regulation.
  • Is false, inaccurate, misleading, offensive, abusive, threatening or defamatory, or that might cause needless annoyance, inconvenience or distress to any person.
  • Misrepresents identity or impersonates any person.
  • Includes any material containing personally identifying information about another person, such as their address, phone number, or email address, except with the written approval of that person.
  • Contains material which is pornographic, obscene, indecent or offensive, which promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age, or that may incite hatred or violence against any person or group.
  • May harass, upset, embarrass or alarm any person.
  • Gives the impression that it emanates from or has been approved by us.
  • Advocates, promotes or assists any unlawful act.

If you are found in violation with and of the above mentioned,  we can and may terminate your account. 

Ordering multiple products

When ordering multiple products as part of the same order, We will inform you on-screen as to whether We will (or can) dispatch Your order as one in the same delivery

Payment

You can pay for your products using credit card, debit card or any other payment method which we make available to you at the time of your order.

The cards and other products sold by us through our Website are manufactured and shipped from a range of different in-house and third-party production facilities based in Jamaica 

Prices and GCT

All prices of products shown on the Website include GCT at the prevailing rate.

Postage and packaging charges

For most items, prices are shown exclusive of postage and packaging charges, these will be shown separately at the checkout stage before you place your order.  In some cases, prices shown may include postage and packaging.  However If this is the case this will be clearly stated.

Substitute Products

Please note that if a product is unavailable, we may substitute it with an alternative product unless you request us not to do so.

 

During the order process, We will generally notify you of the dispatch dates available and the expected time frame for receiving your order, which is usually within 5 days.  However, there maybe delays with the delivery dates or times because We are using a third party delivery service provider.  We will make you aware of delivery charges (if any) before you place your order.

Expected delivery times and charges will differ depending on which products you order.

Dispatch info

The dispatch date is the day we SEND the item you have ordered, NOT the day it will be delivered.

NB. Delivery is only available within Jamaica, We don’t ship oversea. 

 

Before you request a change or cancellation, it is best to check the status of your order by going to ‘Orders’, which can be found under the ‘My Account’ tab.  Orders can only be changed or cancelled if the status is on ‘Order Received’.  If the status displays ‘Order Printing’ or ‘Order Sent’ then it has already been printed or dispatched and, unfortunately, cannot be amended or cancelled.

Emails are answered with 24 hours in the order they are received.  It is therefore possible that your order could begin production before your email is processed and we will be unable to make any changes requested in the email.

At Greeting Yuh, we always try to send your products in perfect condition.  However, occasionally, a problem can/may arise.  In the unlikely event that a product is faulty, or it is damaged in delivery or is the wrong item, we ask you to contact us as soon as possible, so we can advise you on whether you are eligible for a refund or replacement.

 

Use of The Site

You may use and access Greeting Yuh to the extent required for the use of the Services in accordance with Our Terms, and for the purpose that we make them available.  Under this license you may not:

  • Modify or copy the materials.
  • Use the materials for any commercial purpose or for any public display.
  • Attempt to reverse engineer any software contained on Greeting Yuh’s Website.
  • Remove any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or “mirror” the materials on any other server.

This will let Greeting Yuh to terminate upon violations of any of these restrictions. Upon termination, your viewing right will also be terminated and you should destroy any downloaded materials in your possession whether it is printed or electronic format.

Your Account

You may need your own Greeting Yuh account to use certain Greeting Yuh Services, and you may be required to be logged in to the account and have a valid payment method associated with it.  If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account.  Visit https://greetingyuh.com/my-account/payment-methods/ to manage your payment options.

You are entirely responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.  Don’t hesitate to notify us immediately of any unauthorized use of your account and password, or any other breach of security.  You may be held liable for losses incurred by Greeting Yuh or any other user of or visitor to the Site due to someone else using your Greeting Yuh account and password as a result of your failing to keep your account information secure and confidential.

You may not use anyone else’s Greeting Yuh account and password at any time without the express permission and consent of the holder of that Greeting Yuh account.   Greeting Yuh cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Greeting Yuh does sell products for children, but it sells them to adults, who can purchase with a debit or credit card or other permitted payment method.  If you are under 18, you may use the Greeting Yuh Services only with involvement of a parent or guardian.  Parents and guardians may create profiles for children under the age of 18.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Governing Law

The laws of our Country Jamaica, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service.  Your use of the Application may also be subject to other local, state, national, or international laws.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If You are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Legal Compliance

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under this Terms shall not effect a party’s ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

Translation Interpretation

These Terms and Conditions may have been translated if We have made them available to You on our Service. You agree that the original English text shall prevail in the case of a dispute.
